We live in a century where we use internet connection to make things easier for instance shopping online, booking and so many other activities but some of us don’t know how our data is being used or processed. Have you ever asked yourself what’s “data privacy “and “Data protection” when you give out your data to be used especially on social media and any other browsers you logged in to a few minutes ago or before?
Data privacy is how your data should be stored as well as compliance with privacy laws like in Kenya as per the Act 2019 which was developed on 25th November. Data security is how an organization is taking an order to prevent any other third party from accessing your data. Prevents the exploitation of data.
The law also allows individuals to enable them to exercise the right to be forgotten hence consumers’ can take back ownership of their data. In Kenya the DPA (Data Protection Act) came into effect on, November 2019 but its regulation came into effect on 31st December 2021

Referring to a documentary film that was released on July 24, 2019, on Netflix titled “The great Hack” involves a data scandal where Cambridge analytical exposed how it used data to influence various countries in the political game including the United Kingdom, The Brexit campaign and The US 2016 Elections.
Cambridge analytical was responsible for data Mining, which was first reported in 2015 by Harry Davies a journalist for The Guardian which was used to campaign for US senator Ted Cruz. Turned into a scandal that reached a point the Facebook founder Mark Zuckerberg had to appear before the United States congress Committees.
The General Data Protection Represent (GDPR) is a determination of the EU legislators to unify data protection and privacy throughout the EEU and with heavy fines According to recent statistics, the number of fines has increased among the EU Nations. The GDPR would place harsh fines on those who breach it,
In the year 2020 Several big companies were fined due to the privacy breach.
H&M an online clothing retailer was fined $41 million in Germany for” monitoring several hundreds of workers” where they were forced to attend a return-to-work conference after an employee took a vacation/sick leave.
Google was fined $56.6 million this was due to it lacked transparency and inadequate information where it did not give how the consumers’ data were being processed. in addition, the button to refuse cookies is located at the bottom of a second page and was labelled “accept cookies” which was misleading and hence confusing too. The same breach also applied to Facebook where they were fined $59 million
To properly protect and comply with data protection laws you need both data security and data privacy though they look similar the distinction is clearer once you begin to dissect. This shows that data security can exist without data privacy. Laws around the world gives an individual control over their data, which empower them to know how their data is being used and processed, from a business perspective no business can operate without processing personal data this is for their good to achieve consumers’ expectations and they have to use it in a transparent way compliant with the law otherwise they risk huge regulatory fines.
